First they came for the bump stocks…

Well actually, it didn’t start with bump stocks and it won’t end there. But as you may know, ATF has now placed “pistol braces” in its sights. And that means a whole lot of people could become felons for owning something they were already assured was legal.

When the ATF magically turned pieces of plastic into “machine guns” a lot of good Americans were magically turned into criminals. The ruling (regardless of how you feel about bump stocks) was absurd. No matter how you twist things, a “bump stock” is not a machine gun.

Now after years of baffling and contradictory rulings on the legality of “pistol braces” it appears they may be next on the hit list.

A firearms maker, “Q LLC” has been informed by ATF that an AR pistol they have been selling, which appears to be functionally identical to countless other AR pistols, is now considered a regulated short barrel rifle.

ATF’s regulations are usually incomprehensible. But what’s worse is they are ever changing. So being in possession of something that was perfectly legal today, could send you to prison tomorrow, for no reason any rational person can decipher.

The gun in question is their “Honey Badger” pistol. The pistol has a “pistol brace” in place of a stock. ATF has ruled that placing a “pistol brace” on a pistol does not, by itself, convert a pistol into a short barrel rifle.

They have issued confusing and contradictory rulings about whether it is legal to allow the brace to touch your shoulder, in one instance stating ludicrously that if you did allow that, you just “manufactured a short barrel rifle” but they have never stated that simply attaching one to a firearm was unlawful or required that the gun be considered a  regulated NFA item.

So what possible reason could they have to declare that this particular firearm is now an SBR, when countless other examples that are, for all intents and purposes, identical, are not?  The regulation of SBR’s itself makes no sense and is an institutional anachronism . 

People who have already purchased these pistols are now being advised by the manufacturer to either remove the barreled upper and place it on a different lower (apparently they could place it on another lower with the same pistol brace) or to remove it from their possession altogether .

Why it would be legal to simply use a virtually identical lower from another maker is anyone’s guess. What makes this all the more bizarre is that courts have ruled that AR lowers don’t even qualify as “receivers,” so why should they be regulated at all?

ATF has a long history of creating rules that make no sense. And that’s bad enough. But making rules and then changing them so that good people can be arrested is flat out evil. The National Shooting Sports Federation recently reported that the ATF was NOT going after pistol braces. We think they were overly optimistic.

The President has the power to put a stop to this nonsense. And he should. If Biden is elected these kinds of abuses will be just a downpayment on what is coming next, we certainly should not have to face this kind of attack (again) under President Trump.

How The Left Operates.

“If you think these are the comments of a supporter of the Second Amendment, you’d be wrong.”

We’re not going to sugar coat it. We need your help.

The 2020 elections will very soon be upon us. Under Oregon’s vote by mail system, ballots will arrive well before the Election Day deadline.

While we have all spent many years hearing how “this election will be the most important in our lifetimes” we can certainly say that this election will be the most disrupted, chaotic, and potentially dangerous election in our lifetimes.

Oregon, and the entire country, has seen division and conflict grow exponentially since the last presidential election and the violence has been increasing at a frightening pace in the last few months.

Firebombs and gun fire at “peaceful protests” are becoming regular occurrences.  In many places it has become literally life threatening to express an unpopular point of view.

We fully expect the outcome of the next election, no matter what it is, to be contested.

It is very likely that it will be contested violently.

It is also probable that the results of the election will not be determined for some time after Election Day.

The current vacancy on the Supreme Court is only adding to the tension and conflict gripping our country. Social media is controlled and manipulated by the anti-gun left. (OFF’s Twitter account has been blocked.)

Here in Oregon, riots have become a nightly occurrence and the people in power have made no secret of whose side they are on. And that is extremely dangerous.

As you know, the current super majority in Salem has made new and draconian gun restrictions a priority. It’s safe to say that the only reason you may still have a self-defense firearm accessible in your home is because the minority Republicans walked out last session.

Right now, persons attempting to purchase firearms are often placed “in the queue” with up to 5000 people ahead of them.

And while Oregon law requires that dealers get a response to a background check inquiry within 30 minutes, some customers are waiting days and weeks just for the process to begin. The Oregon State Police are also “cancelling” some sales with no determination, something that they have no legal authority to do.

Some sheriffs are delaying CHL applicants months before accepting an application, placing many people in danger through no fault of their own.

Oregon is becoming a very hostile place for gun owners. 

That’s why it is so critical that Oregon gun owners make their voices heard this election. If there is no significant change in the balance of power in Salem, the attacks on your rights, your property, and your freedom will be savage and endless.

The Oregon Democrats are still seething that their plans to render your firearms useless were thwarted in the last session. Their efforts to eliminate gun rights will be in high gear no matter who becomes the next President. Not a single gun owner, or person who thinks they may own a gun in the future, can sit this election out.

The wildfires that have devastated so much of the state have displaced vast numbers of voters, and while the Secretary of State has announced ways for them to vote, you can rest assured that many, many, votes of rural Oregonians will not be counted.

Oregon Firearms Federation supporters are used to facing challenges to their rights. In a state that has been controlled by militant anti-gunners for many years, you have managed to hold them at bay against all odds. It’s no secret that in the last few years these battles have become harder and riskier.  It’s only because of your endless activism that we have any rights left at all.

But the fights are getting more brutal and more expensive and frankly, we can’t do anything without your support. So in the midst of all this madness we have to reach out and ask for your help.

In the wake of the murder of an unarmed Trump supporter by a leftist “peaceful protester” Oregon’s leading democrats were quick to condemn…Trump supporters.

Anyone who still believed that the ruling party in Oregon was anything but a cheerleader for Marxist carnage had that fairy tale stripped away by the demented, disgraceful, and unhinged responses of Oregon’s leading democrats to the cold blooded killing .

After almost 100 days of violent rioting by leftist extremists, Kate Brown said:

“Time and again, from Charlottesville to Kenosha to Portland, we have seen the tragic outcome when armed right-wing vigilantes take matters into their own hands. Gun violence is never, ever the answer.”

“Whether it’s his completely incompetent response to the pandemic, where nearly 200,000 have died(sic), or his outright encouragement of violence in our streets: it should be clear to everyone by now that no one is truly safe with Donald Trump as President.”

In what can only be described as surreal the “Oregonian” reported:

  “The governor said she would also hold a community forum with Wheeler and Black protest organizers to discuss racial justice and police reform in Portland. She did not specify when that forum would happen.”

Portland’s Mayor, who has stood meekly by while his city has turned into a third world hell hole, has pledged to reach out to the rioters to discuss their “hurt” and blamed the President for the havoc his own people have created. (The violent extremists are still demanding he resign to be replaced by someone even more disturbed and dangerous.)

Oregon’s socialist Attorney General tweeted “We already know the President is morally responsible. His conduct is craven and cowardly.”

(Updated 09.02.2020 for clarity) According to the Oregonian, (referring to a previous incident) the murderer, Michael Forest Reinoehl,:

“…was cited at 2:10 a.m. in the 700 block of Southwest Main Street on allegations of possessing a loaded gun in a public place, resisting arrest and interfering with police.He was given a date to appear in court later that month, but the allegations were dropped on July 30 with a “no complaint,” according to court records. The documents don’t indicate why prosecutors decided not to pursue the accusations. Reinoehl spent no time behind bars.”

This should come as no surprise. Multnomah County has long had a policy of refusing to prosecute radical leftists even when  their crimes are documented on video tape. Needless to say, the county is still prosecuting anyone they perceive as “conservative” even when the charges are clearly false.

After the murder, rioters attacked a Portland gas station when the mob was falsely told that the person killed was a black man. When word got out that the murdered man was a Trump supporter, they celebrated.

Meanwhile all of Portland’s legacy media continue to create false narratives about what is happening in Portland.

Although the left and its lapdogs in the press continue to pretend that the violence and destruction is confined to a few blocks in Portland, the reality is the mobs have been spreading their hate into residential neighborhoods and attacking families whose only crime was thinking (foolishly) they could safely go into downtown for a meal.

The Oregonian referred to the most recent riot as “subdued” and accused the Portland Police of “setting a low bar” for declaring an “unlawful assembly” . In a quote that would be comical if people were not dying, the Oregonian said “Police have been tolerant of protesters’ blocking traffic while taking a dimmer view of thrown objects, fires and other provocations.”

(Notice their failure to mention what some of those “thrown objects” are.)

In fact, the people who are destroying Portland (and now moving out to disrupt and threaten other locations in Oregon) are well armed, extremely violent and preparing for more armed conflict by equipping themselves with body armor purchased with crowd sourced funds.

It is now undeniable that Oregon’s ruling party is not “tolerating” or “allowing” the murderous violence rocking our state, it is actively encouraging it.

While unarmed and innocent people are gunned down on our streets, Oregon’s power structure is working overtime, not to quell the violence, but to further hamstring the already outmanned police.

We are clearly well past a “turning point.” The charade of “peaceful protest” is over. Our streets are quickly becoming battlegrounds and there is no reason to think things will improve. Marxist revolutions are about bloodshed, and the response to the endless carnage on our streets by elected officials guarantee that the violence will continue and escalate.

The vile comments by leading Democrats make it clear that no matter how much violence is perpetrated by their comrades, YOU will be blamed.

As Portland continues to burn, the Democrats in the Oregon Legislature continue to work on looter protection laws.

The violence continues at the nightly peaceful protests but the chairs of the “Joint Committee On  Transparent Policing and Use of Force Reform,” Jaynell Bynum and James Manning (below top right and bottom right) have shown no interest in doing anything to stop the mayhem, instead concentrating on a slate of bills to restrict police.

In today’s hearing, far left, militant anti-gun Senator, Floyd Prozanski (bottom left in photo) made the mistake of wondering if there were alternatives to the tear gas the Democrats are working to ban outright.

He mentioned “water cannons” and hypothetically inquired whether they might be used to control criminals who were rioting and endangering innocent people.

This “triggered” Chair Bynum who responded by asking Prozanski if “we are talking about hoses and dogs here.”

Prozanski was offended by her comments and the ensuing sparring was like watching a bad day at the woke olympics. 

For the record, Prozanski never mentioned a word about dogs, but the reference to water was enough to cause painful cultural flashbacks for Bynum, who was not even born when dogs and firehoses were used against protesters in the south.

As has become the norm at these remote hearings, technical flaws ruled and anyone who was testifying in favor of more restrictions on police response to riots was given extra time.

There are, without doubt, vast improvements that can be made in police procedures and accountability. And those should be carefully considered and acted on. But it’s safe to say that any changes made to police procedure will be made to benefit whoever is in power when the changes are instituted.

“The magistrate judge threw out allegations that Gov. Kate Brown was in any way liable for Finicum’s death, finding that the governor did not participate in the encounter at the roadblock or the shooting.”

At no time has any legislation been considered to address the chaos that has turned parts of Portland into the set of a zombie apocalypse movie.

On August 10, the Oregon Legislature convenes for another “special session.” While the session is intended to address Oregon’s catastrophic budget shortfalls, both House Speaker Tina Kotek and Governor Brown have made it clear they intend to use the session to push through as many policy changes as possible.

Republican leadership has stated that they oppose dealing with anything other than budget issues, and Democrat Senate President Peter Courtney has signaled his opposition as well, but few people in Salem still believe that Courtney is calling the shots and it’s clear that far more radical leftists are in control of the agenda.

This means that everything is on the table. You will recall that during the last regular session, the Democrats were working to eliminate self defense by requiring gun owners to keep their firearms locked up and useless.

That bill failed only because the Republicans walked out of the session. Everything is up for grabs in the special session, but now, because the Capitol is off limits to the voters, (and us) tracking legislation is far more complicated and the potential for abuse is higher than ever.

Elections are coming up, and the ruling party does not know if their history of failed policies on many matters will cause them to lose seats. So they may well be feeling like now is the time to try to enact as much of their tyrannical agenda as possible.

Rioter Protection

While cities across America are burning, Portland continues to make national news as the site of some of the worst violence.

Almost all major media outlets regularly downplay the level of chaos by continuing to perpetuate the myth that most of the rioters are “peaceful protesters” and showing only selective video of the carnage on the streets of the city.

We have received very reliable reports that persons associated with the “protests” are buying quantities of body armor and distributing them to participants.  No word on who is providing the funds for these items.  Gas masks are also being snatched up by people who have made no secret that they plan to use them while participating in the riots.

Meanwhile, as you may have already noticed, ammunition prices are rising, and supplies are shrinking.

While attempts at firearms sales are way up, we are still hearing, virtually every day, from people who are experiencing lengthy delays in approvals for purchases. In many cases, these delays are before the checks are actually started. Meaning some are waiting just to have the process begin, and then facing delays after the State Police initiate the checks.

While both state and federal law allow a buyer to take possession of a firearm from a dealer without state approval while being “delayed,” (if 3 or more business days have “transpired,”) that only applies once the background check process has actually begun. So if you are waiting days or weeks just to have the process started, you have no such protection.

Keep in mind, although the law allows such transfers, it does not mandate them and very few firearms dealers are willing to risk the wrath and retribution of the ATF by actually transferring a firearm without state “permission.” Furthermore, the background check system is erratic with some getting approvals instantly and others waiting for weeks or more.

Supplies of firearms themselves are down and in some places your chances of finding what you want are iffy at best.

Meanwhile, Oregon’s Democrat majority is responding to the violence with more proposed legislation.

“Legislative Concept 743” implements new rules for police uniforms. Among them:

 Except as provided in subsection (2) of this section, at all times that a peace officer is performing official duties other than participating in an undercover law enforcement operation, the peace officer shall wear a uniform consisting of a light blue or white shirt and navy blue pants. The uniform may include a navy blue jacket.

(2) A peace officer may not wear a uniform consisting of all black or dark blue clothing unless the peace officer is participating in a special weapons and tactics (SWAT) team or correctional emergency response team (CERT).

(3) A peace officer may not wear a visible tactical vest unless the peace officer is participating in a special weapons and tactics (SWAT) team or correctional emergency response team (CERT).

Section 2 of the bill says:

SECTION 2. (1)(a) A peace officer performing official duties in uniform shall prominently display, in lettering legible to a person with average vision in all weather and light conditions from a distance of  at least 25 feet, the peace officer’s first and last name, badge number or other identifying number and information sufficient to identify the peace officer’s employer.  

(b) A peace officer who is performing official crowd control duties shall prominently display on both the front and back of the peace officer’s uniform, in lettering legible to a person with average vision in all weather and light conditions from a distance of at least 25 feet,the peace officer’s last name, badge number or other identifying number and either the word “police” or the words “lawenforcement.”

(c) A peace officer performing official duties other than participation in an undercover law enforcement operation shall, upon request, provide a member of the public with the peace officer’s name and badge number.

Of course, the bill has an “emergency clause.”

“Legislative Concept 742” severely restricts use of pepper spray, tear gas, and “less than lethal” devices and requires that police give advance notice to rioters of their use. Less than lethal projectiles may only target certain parts of the body. If a police officer hits any non approved body part his department may be sued for two years. Police may not use these devices against people who are “houseless.”  No word on how “houseless” people are to be identified among rioters. When police are allowed to use these devices, they have to “accommodate disabilities.”

Legislative Concept 745 forbids police and corrections officers from using “physical force that impedes the normal breathing or circulation of the blood of another person by applying pressure on the throat or neck of the other person” under any circumstances.

The Joint Committee On Transparent Policing and Use of Force Reform, which is the committee holding hearings on the police bills, has blatantly stacked the deck with witnesses who openly favor the rioters and shuts down input and questions from Republican members. Committee Chair Janelle Bynum actually shut down the committee proceedings when State Senator Dallas Heard asked who was responsible for the rioting downtown. Bynum said it would “put people in danger” if they were revealed.

The ruling party is making no secret of its efforts to protect the people who are destroying Oregon’s cities while doing all they can to hamstring and neuter the police. Meanwhile, Governor Brown continues to enact new restrictions on gatherings of the law-abiding while encouraging massive crowds of violent anarchists. Apparently rioting keeps you safe from viruses that attack church goers and wedding guests.

There does not seem to be any end in sight for the chaos and we cannot predict how the coming elections will go. Once again, we strongly urge you to take whatever steps you still can to keep yourself and your family safe.

Gun owners were victorious in Clackamas County today.

Pro Gun Rights Attorney Shawn Kollie successfully defended Warren Mitchell’s right to have an Oregon Concealed Handgun license in spite of the fact that he is technically homeless.

While currently homeless, Mitchell was nevertheless a longtime resident of Clackamas County. He received mail, including a government stimulus check, at a Clackamas County facility and met every other qualification.

Clackamas County denied a renewal for him based on their position that he was not legally a resident of the county.

Oddly, the County said in their petition defending the Sheriff’s refusal to renew:

It should be noted that although the term “resident” is not defined in ORS Chapter 166, it is defined in several other Oregon statutes. A common and helpful definition of “resident” is a person who has resided within a specific city, county, or the State  continuously for at least six months prior to date of an application.

This is strange because ORS 166, the section of Oregon law that deals with firearms, very specifically DOES define “resident”, in this case exactly for the purposes of obtaining an Oregon CHL.

As we noted, and as Attorney Kollie pointed out, Mr. Mitchell met every single requirement.

The panic caused by Covid has created many new challenges for gun owners. Obviously for many, simply buying a gun has become very difficult. For quite a long time, Clackamas County used Covid as an excuse to refuse to issue new permits or even renew existing ones.  As of today, they are  issuing and renewing but there is no telling if they will continue given the Governor’s every changing draconian mandates and shut down threats.

We are grateful for the excellent work of Mr. Kollie and pleased that Warren Mitchell is not being denied a basic right because of his current housing situation.

Police “Reform” Hearings.

Starting tomorrow, the “Joint Committee On Transparent Policing and Use of Force Reform”  will begin three days of hearings on police “reform.”

At the time of this alert, none of the “presenters” had been announced and no meeting materials have been posted although that could change by the time you read this.

Once again, you, the Oregon voter, may not enter your capitol building and you can only participate if you are one of the lucky ones who somehow manages to get past all the technical failures these “remote” hearings have become notorious for.

We support responsible policing. We also recognize that any authority can be abused. We certainly learned that when Michael Strickland was railroaded and Lavoy Finicum was killed.

We have seen no shortage of police abuses around our country for many years including the misuse of no-knock warrants and illegitimate firearms confiscations.  (Please note, David’s case is over, we are NOT collecting funds on his behalf anymore.)

We believe “qualified immunity” is routinely used to protect bad actors under color of law.

That being said, we also  recognize that the people in power in Oregon are encouraging and promoting the chaos and lawlessness on our streets and doing all they can to undermine the police. Police who, these days, have an absurdly thankless job.

We also believe that Oregon Democrats are twisting the reality of abuse by authorities into a strictly racial issue, which we know it is not. They are very successfully creating division and animosity by turning groups of Oregon citizens against each other.

And as you no doubt know, our cities are becoming very dangerous very quickly at the same time Oregon politicians are following the lead of leftists elsewhere in the country and moving towards slashing police funding.

Meanwhile, extreme left wing operatives are taking over DA’s offices.

And so we are watching with serious concern as our legislature, controlled by radical leftists, addresses “reform.”

What they will not be addressing is the complete disaster the Oregon State Police have become at processing firearm’s transfers. While never a good or even legitimate system, the surge in attempted purchases, coupled with Oregon’s policy of sending many state workers home, has created a monumental backlog in transfer attempts.  People are waiting weeks for an “approval” to exercise a “right”,  and many are waiting days and longer just to have the process begin, only to find out later they are being delayed for weeks or more.

What they also will not be addressing are the many sheriffs who simply stopped issuing concealed handgun licenses with no legal authority to do so. (Clackamas County only yesterday started accepting applications but we have heard from numerous people who said the process was not working and they could not complete applications.)

We believe that given the bias of the controlling party and the current environment of lawlessness, that there is a strong possibility that these hearings will be used to further erode police moral and effectiveness while doing nothing to address real abuses that are always a reflection of the party in control at the time.

“Special” Session Set For June 24.

Kate Brown has called for a “special session” starting June 24th.

It appears at this time that there will be NO budget bills but plenty of “police accountability” bills considered.

Most Democrats have been very supportive of recent anti-police demonstrations while still warning us to wear masks and stay away from crowds.

Any pretense of reason and objectivity has been abandoned.

The same people who are calling for the “defunding” or outright abolition of police forces are demanding that your right to defend yourself and your family evaporate. We have seen the outcome of state support of looting and rioting and there is no reason to believe it is going to get better anytime soon.

Democrat Rob Wagner, the new Senate Majority Leader, said:

“We have the opportunity to listen to our colleagues in the People of Color Caucus and the tens of thousands of Oregonians calling for an end to police brutality and systemic racism. We must start that work now.”

Democrat House Speaker Tina Kotek said:

“And, across the state, we’ve seen the public take to the streets for weeks demanding police accountability reforms to address the tragic prevalence of police brutality and racial injustice in our society.”

So far we have not seen a word from any elected Democrat condemning the massive destruction caused by those demanding an end to “brutality”.

It’s become undeniable that the people in power are supporting the violence that we have seen in Oregon’s cities, and that’s what will make a “special session” so dangerous.

While we always expect the majority (with a few turncoat Republicans) to use every opportunity to ram through new attacks on your rights, this “special” session will not even have the normal procedures for the public to monitor the actions of the legislature.

The Capitol building is still closed to the public and there will be no opportunity for live public testimony.

The ruling party is NOT limited in any way in terms of what bills they can promote and ram through.

We know they are still furious that they were unable to force more dangerous gun bans through in the last regular session because of the Republican walkout.

The Governor has made no secret of her desire for “revenge” nor has she hidden her allegiance to the rioters. 

While attempted gun sales are at an all time high, Oregon’s “instant” background check system is in the worst shape ever as most of the employees who work the “Firearms Instant Check System” unit are “working from home” with no reliable access to the system. Those attempting to buy guns are facing up to 5000 people ahead of them in the “queue.”

So, while law enforcement in many places is standing down, the law abiding are struggling to have the means to defend their homes.

This “perfect storm” of events has created the most perilous situation in memory.

OFF will be doing everything in our power to monitor events in Salem, but the circumstances we are facing are unprecedented.

We have to assume that the Democrats will be taking advantage of the current chaos to force their radical agenda.  We strongly urge you to take whatever steps you deem necessary to keep yourself and family safe.
