As you may know, for some time the Oregon State Police’s Firearms Instant Check System Unit has been denying firearm transfers to people who have had convictions expunged or “set aside.”
It has been our opinion, and the opinion of a number of Second Amendment lawyers, that this policy is unlawful.
Some of those lawyers have been working behind the scenes for several months to craft a lawsuit to stop this unlawful practice.
Several attempts were made to reach out to the U.S. Department of Justice, requesting that this practice be stopped in an effort to avoid what certainly would have been costly and protracted litigation. Today, those efforts paid off.
Attorney Ross Day, (who defended our Foundation against a years-long attack of lawfare) received word from the ATF that it agreed the policy was unlawful. This is fantastic news.
We expect it will take some time for the word to make its way through the many layers of bureaucracy and finally reach the FICS unit, which seems primarily interested in being an obstacle to gun transfers. But it’s a great start, and we are pleased to be able to report it.
