The Fight For Personally Made Firearms Continues
10.31.2025
As you know, with the complicity of Oregon Republicans, the Democrat-controlled Oregon Legislature banned the possession or creation of personally made firearms with HB 2005 in the 2023 session.
This bill turned the Second Amendment on its head by outlawing firearms you made yourself. You could not even legally own the ones you had already made unless you had a serial number engraved on them by an FFL. However, the simple possession of one was already illegal so even if you could find an FFL willing to apply an approved serial number you were already a criminal just by having something that was always legal before this insane bill went into effect, and that is still legal under federal law.
Oregon Firearms Federation joined its partners at the Firearms Policy Coalition and filed suit against this clearly unconstitutional bill. To no one’s surprise the suit was dismissed by the US District Court.
Now a Second Amended Complaint has been filed. Firearms Policy Coalition President Brandon Combs said: “With this amended complaint, the Court has two choices: either hold Oregon’s feet to the fire or ignore the Supreme Court’s precedents altogether. Oregon completely banned an entire mode of exercising the right to keep and bear arms by eliminating the ability of people to make their own arms for lawful purposes. The State bears the burden of proving that its immoral scheme to criminalize rights is consistent with the Nation’s historical tradition, and they will fail. Our Second Amended Complaint clearly shows that the right to keep and bear arms includes the right to make them.”

For a court to uphold a law that bans Americans from making firearms is as absurd as the creation of the law itself. Once again, Oregon legislators and Oregon judges have demonstrated a complete disregard for the US Constitution and their oath to uphold it. We are deeply grateful for the work that the FPC has been doing to help us protect Oregonians’ rights.
There is another long battle ahead. We’ll keep you posted.
